This Privacy Notice informs you of ResultsCX (“us”, “we”, or “our”) policies regarding the collection, use, disclosure and protection of, as well as the choices you can make about, your Personal Data.
When we refer to “Personal Data” we mean any information about a living individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data). ResultsCX is made up of different legal entities, details of which can be found below in the Annex. This Privacy Notice is issued on behalf of the ResultsCX group so when we mention "ResultsCX", "we", "us" or "our" in this Privacy Notice, we are referring to the relevant company in the ResultsCX group responsible for processing your Personal Data.

We may collect Personal Data in a variety of situations and will only use it when we have consent, or where there’s legitimate business reason for accessing or using it.
Comply with Legal Obligations: In certain cases, we may have a legal obligation to collect, use or retain your Personal Data.
Below is the information we collect or which you may directly and voluntarily provide to us:
We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.
Where we need to collect Personal Data by law, or under the terms of a contract we have with you, and you fail to provide that Personal Data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with services). In this case, we may have to cancel a service you have with us but we will notify you if this is the case at the time.
We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.
If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.
Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.
A cookie is a small file that can be placed on your device that allows us to recognize and remember you. It is sent to your browser and stored on your computer’s hard drive or tablet or mobile device. When you visit our sites, we may collect information from you automatically through cookies and similar technology. This information may include your non-personal registration information, user preferences, and online activity.
We use cookies to ensure that we give you the best user experience. You can set your browser to refuse all or some browser cookies, or to alert you when websites set or access cookies. If you disable or refuse cookies, please note that some parts of this website may become inaccessible or not function properly.
We use appropriate security measures to prevent your Personal Data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your Personal Data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your Personal Data on our instructions and they are subject to a duty of confidentiality. The transmission of information via the Internet is, unfortunately, not completely secure and although we will do our best to protect your Personal Data, we cannot guarantee the security of the data during transmission via our websites. Our security procedures mean that we may request proof of identity before we disclose Personal Data to you.
We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
Privacy regulations state that Personal Data shall be kept for no longer than necessary for the purposes for which it is being processed. The retention of Personal Data is guided by the amount, nature and sensitivity of the Personal Data, the potential risk of harm from unauthorised use or disclosure of your Personal Data, the purposes for which we process your Personal Data and whether we can achieve those purposes through other means, and applicable company standards, the requirements of our clients and regulatory considerations. We will only keep personal information for as long as necessary and for legitimate business reasons.
We may share your personal information if required to comply with the law. Internally, we share customer information with clients with whom our consumers are conducting business. We may also share your Personal Data with authorized service providers that store and process data on our behalf. We require all third parties to respect the security of your Personal Data and to treat it in accordance with the law. We do not allow our third-party service providers to use your Personal Data for their own purposes and only permit them to process your Personal Data for specified purposes and in accordance with our instructions.
We will share your Personal Data with professional advisors, including lawyers, bankers, auditors and insurers who provide consultancy, banking, legal, insurance or accounting services.
We will share your Personal Data with regulators and tax authorities where we are required to report to these organisations in certain circumstances.
We may share your Personal Data with third parties to whom we may choose to sell, transfer or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your Personal Data in the same way as set out in this Privacy Notice.
ResultsCX does not share your Personal Data with third parties other than as disclosed within this privacy notice.
ResultsCX transfers Personal Data between group companies, to clients within country who may, in turn, transfer data internationally, and to a cloud-based storage provider.
ResultsCX only transfers data outside of the European Economic Area (“EEA”) or UK where it is compliant with data protection legislation and the means of transfer provides adequate safeguards in relation to such data, for example: (1) by way of an International Data Transfer Agreement, incorporating the current standard contractual clauses adopted by the Information Commissioner (for the UK) and the European Commission (for the EEA) for the transfer of Personal Data by controllers in the UK or EEA (as applicable) to controllers and processors in jurisdictions without adequate data protection laws; or (2) transferring data to a country where there has been a finding of adequacy in respect of that country's levels of data protection via its legislation; or (3) where it is necessary for the conclusion or performance of a contract between ResultsCX and a third party and the transfer is in the data subject's interests for the purposes of that contract (for example, to a service provider based outside the EEA).
To ensure that your Personal Data receives an adequate level of protection, we have put in place appropriate contractual wording with the third parties we share your Personal Data with to ensure that your Personal Data is treated by those third parties in a way that is consistent with and which respects the law on data protection.

If you are a California resident, in addition to the rights set forth in this Privacy Notice, you have the right to request information from us regarding how we collect and share certain categories of your personal information.

You can exercise your rights by contacting us using the information set out below in the Annex. You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances. We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Data (or to exercise any of your other rights). This is a security measure to ensure that Personal Data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
We do not knowingly collect, process, use or maintain personal information from individuals under the age of 18. If you are a parent of a child under 18, and you believe that your child provided us with information about himself or herself, please contact us immediately.
To reflect changes in our business practices or regulatory changes, we will review our policy at least annually. If we change the way we handle your personal information, we will update this Privacy Notice. We reserve the right to make changes to our practices and this Privacy Notice at any time, please check back frequently to see any updates or changes to our Privacy Notice.
